Letter of Plead for Witness: Female Singaporean got scammed in China, assaulted by Male Chinese PRC after refund & accused by travel agency PRC boss.

I recently went to Hainan Island, China after buying a tour package of SGD50/- per pax through an online deal at what I thought was a great bargain.

We went down to the travel agency named “Travelstar Pte Ltd” at #02-12 People's Park Complex to collect our itinerary and was brief that there was some "optional" daily tour places that we "may" choose to go.

The itinerary was not from Travelstar and was printed in full Chinese version from a China agency (Hai Kou Ming Jian Lv Xing She You Xian Gong Si,海口民间旅行社有限公司) which the itinerary does not matches the one offered on the online deal website.

Little did I know that it was actually the beginning of a nightmare!

During the entire trip, we are being rush from one hotel to another, following cluelessly and helplessly the instruction of the tour guide who purchases all the "optional" tickets without our consent and without leaving us any other alternatives if we were to opt out.

We are totally at their mercy in a foreign land.

We were brought to this medical hall (Bao Shu Tang,宝树堂) and this is the beginning of the horrible ordeal that was to come. The proclaimed "physicians" of the medical hall diagnosed each and individual with serious health issues especially the kidneys problems and if we do not consume their medicine immediately, we will be required to go through kidney transplant within the next 3 months.

Many of our tour mates including my parents bought the medicine because they are fearful and pressurised of the health issues diagnosed by all these "physicians".

Upon returning to Singapore, we quickly Google on the medicines we bought and realised that one of the product from Bao Shu Tang has excessive lead content, was unsafe for consumption and banned by the Canadian Health Authority. We did a check with some of the friends in China and they mentioned that Bao Shu Tang was well known to tourists but not the locals.

Based on the information gathered, we decide to seek a refund from Bao Shu Tang as we have no faith and confidence in their products.

We approached Travelstar to help us on this issue but they deny their responsibilities and reminded us that it was only a "$50" package. One of the staff told us as a matter of fact that we are in China and should have expected this sort of things to happen and refuses to help us. The lady boss (a PRC by the name "Mdm S") of Travelstar called up to make an offer to my sis that she can refund the package fee plus some compensation but we have to drop the matter and not to pursue anymore.

We decided to lodge a Group police report with the rest of the people in our tour group who purchase from the range of SGD500 too SGD6,000 worth of medicines from Bao Shu Tang.

We sent over the police report to the lady boss but she still refused to help, stating that she is well versed with Singapore police procedures and understood clearly that there is NOTHING we can do about her.

One of our tour mate (Mr H) decided to lodge an additional personal police report with the Hainan Police Authority and also lodge a complaint with the China Consumer Association. The authorities in Hainan started investigating the matter and Bao Shu Tang finally agreed to return the money. Mr H was the first to get his refund through a china account.

Bao Shu Tang wanted Mr H to keep quiet after getting his refund of SGD6,000 and not to disclose to other tour mates that he had gotten his refund back. Mr H detests their behaviour and felt that it was only right to inform the rest so that we can get our refund.

My sis then proceed to call Bao Shu Tang and they agreed to refund our SGD1,000 on the conditions that we do not disclosed to other tour mates of the refund. My sis felt disgusted by their offer and informed them that it is only right that they refund everyone their money or we may also have to lodge our own personal police report with Hainan police authority in China.

Bao Shu Tang initially said that they will return the money only to my sis and told her not to tell the rest about this. After the money was transferred to my sis, the medical hall boss called my sis and told her the money has been transferred and told her not to be a "busybody" and meddle with other people's business as the rest of the tour mates did not ask for the refund back.

Finally, after much consideration, Bao Shu Tang decided to refund everyone in the tour group who lodged the police report the full amount and instructed us to return all the medicine we purchased back to Travelstar.

After all of us received the refund, we decided to go down to Travelstar on 23 Aug 2011 at around 7.10pm to return the medicine. When we arrived at Travelstar, Mdm S was quite surprised and pissed that our whole group appeared there without informing her.

She totally ignored us even though we told her we were there just to return the medicines as instructed by Bao Shu Tang. She told us she is serving a customer and instructed us to wait and her attitude was very bad throughout. After she is done serving the customer, she continue to ignore us and went over to a staff who was serving other customer and just stand there and listen to their conversation, totally oblivious to our presence.

I then walk over to her and ask if it was our turn yet. She looks displeased, walk back to our side and talk to us in a very rude manner. We told her that we had all brought the medicine here, and we simply just wanted to return them and leave. She tried to be difficult and took her own sweet time so we told her that we are in a hurry and will just leave the medicine in her shop as instructed by Bao Shu Tang.

We decide to sign on some documents to prove that we had return the medicine and she said we can just leave if we want to since we are in such a hurry and snatch the document from us. While she is talking to another tour mate, my sis took the document on the table and went ahead to sign on it. I also quoted to Mdm S that the date is 23 Aug, the time is 7.30pm and I then took out my phone and wanted to take a picture of my sis signing the document as a proof of return. Mdm S snatched my phone from me, furiously shouting at me as why I am taking photo of her and threw my phone across the shop to the other end. I was angry and reacted by pushing her laptop off the table. I pointed my fingers at her, asking her why did she throw my phone and she gave me a slap. My sis was shocked and asked her why she slapped me and she slapped my sis as well. By this time, Mdm S went crazy and started slapping and kicking us. We were tempted to fight back but she keeps pushing out her tummy and says that she is pregnant everytime we tried to retaliate. When we backed off, she started slapping us, kicking us and at the same time yelling that she is a pregnant lady. She even pulled my sister's hair and when my sister wants to pull her hair back, she again yelled that she is a pregnant lady and my sister had to withdraw her hand.

The ironic part was throughout the entire incident, she kept crying and screaming that she is a pregnant woman and we should not touch her but she keeps sending her slaps and kicks aiming at us the whole time. She even picked up a chair over her head and throw at us twice.

The 2nd time when she lifted the chair over her head to throw at us, the legs of the chair hit a glass panel behind her and cracked. We were all stunned by her actions as her tummy was big but her strength was bigger. Mediacorp might want to contact her because I must say that her acting skills were “excellent”.

After the 1st time she lifted the chair to throw at us, one of her staff (a male Chinese PRC in ponytail) came over and screamed at us in chinese that we should not hit pregnant woman even though we didn't. We told him it was Mdm S who was hitting us. Everyone had all witnessed the whole scenario and that we did not hit her at all. The male PRC refuses to listen and keep scolding vulgarities at me and his action seem like he is about to hit me. I warned him not to lay a finger on me as he is a man and he shouldn't beat a woman, just as we wouldn't hit a pregnant woman.

He simply told me he don't “fxxx care”, suddenly throw a punch on my left cheek and wanted to throw a few more punches at me. Fortunately for me, one of my tour mate (Uncle T) was beside me and quickly grab hold of the male PRC to prevent him from throwing more punches at me. But the male PRC pushed me real hard and I fell back on the ground. My tour mates and my sis help me up and saw the male PRC lifting up the chair and threw it at me. By this time, the chair hit the glass panel again causing it to shatter into pieces.

Luckily Uncle T blocked the chair attack from the male PRC with his arm or I think I would have suffered serious injuries and fractures. We then called the police.

We lodged another police report and I went to the hospital to inspect for injuries. I suffered serious bruises all over, on my arms from the blocking of attacks, scratches on my neck from Mdm S, bruises on the knees from Mdm S's kicks, injuries on the pelvic bones from the PRC man's push and sore bruises on my cheek from the PRC man's punch.

Despite all these, newspaper articles reported her as the victim and she even wants to sue me for compensation for the damages in her shop and her "injuries".

If we had really hit her, why were we seriously injured and not her?

If we had really hit her, why do her staff and the people there not stopped us? You mean to say everyone there is inhuman staring at us all attacking a pregnant woman?

My whole tour group witnessed the entire incident and are willing to testify that we had not hit the pregnant woman. Her injuries were self inflicted while she went berserk trying to hit us and now she is accusing me & my sis of causing her all her injuries. She claims that she suffered the danger of losing her babies because we had pushed her, and will sue us if she had a stillbirth, and I am responsible for the death of her unborn child.

I beg anyone with any information regarding this matter to step forward as a 3rd party witness since the police indicate that witness statement from our tour group is deemed to be bias and the Investigating Officer of this case told us that a few of her staff had given statements that they did not see anything at all as it “happens too fast”. For your info, the whole incident actually lasted at least 10 to 15 minutes.

I only want justice to be done and for the man who assaulted me to be brought to justice, and not being falsely accused of hitting the pregnant woman, endangering her unborn child and damaging her properties.

Nowadays companies tends to con people. Report to case. And report police. For the tour agreement. That the breach of trust. I believe u can claim compensation.
